New Motor Vehicle Show

A new motor vehicle show consists of more than one new motor vehicle dealer, dealing in competitive types of motor vehicles displayed at a location other than their licensed location.

If any provisions as set forth in 4517.22 of the Ohio Revised Code have been violated, the Motor Vehicle Dealer Board may order an administrative penalty for each violation, including but not limited to each sale that occurs, and each day a violation occurs or continues to occur.

NOTE: Only a manufacturer or distributor is permitted to display a single unit new motor vehicle, except as permitted in O.R.C. 4517.22.

Requirements

Any sponsor of a new motor vehicle show must comply with the following:

  • The sponsor must submit an affidavit requesting the Registrar’s approval not less than 30 days before the planned opening date of the show.
  • The sponsor must send an invitation to ALL new motor vehicle dealers licensed under Chapter 4517 of the O.R.C. dealing in competitive types of motor vehicles in the designated general market area, as defined in O.R.C. 4517.22. The invitation(s) must be reasonable and nondiscriminatory.
  • A show may not last more than 10 days.
  • No contracts may be signed, deposits taken or sales consummated at the location (with the exception of livestock and agricultural shows pursuant to O.R.C. 4517.2).
  • There must be two or more competitive type new motor vehicle dealers present at all times during the duration of the show.
County Fairs/Agircultural Society Sponsors

If the show is being held at the annual fair of a county or independent agricultural society, the sponsor must comply with the following:

  • The sponsor must submit an affidavit requesting the Registrar’s approval not less than thirty 30 days before the planned opening date of the show.
  • The sponsor must send an invitation to ALL new motor vehicle dealers licensed under Chapter 4517 of the O.R.C. dealing in competitive types of motor vehicles in the county where the fair is being held. The invitation(s) must be reasonable and nondiscriminatory.
  • A show may not last more than 10 days.
  • Permission may be granted if only one new motor vehicle dealer accepts the invitation to participate at the fair, provided that all other requirements of O.R.C. 4517.22 have been met.
Record Retention

All sponsors that have filed an affidavit(s) with the BMV for a motor vehicle show must maintain a copy of the affidavit(s) for their records for one year from the last day of the show.
