Public Hearing Notice: The Ohio Department of Public Safety, Bureau of Motor Vehicles, Dealers Board ("Board"), pursuant to Chapter 119, Ohio Revised Code, will conduct a public hearing for the purpose of soliciting comments regarding the adoption, amendment and recession of rules. The public hearing will be conducted on December 3, 2015 beginning at 9:00 a.m. in room 1107, located at 1970 West Broad Street, Columbus, OH 43223

The following rule is proposed to be rescinded and a new rule adopted in its place: 4501:1-3-08 Place of business required for used motor vehicle dealers.

***IMPORTANT INFORMATION***
The newly-designed Dealer Licensing Online Services will go live on October 26, 2015. All online services will be unavailable all day Sunday, October 25, 2015, including reporting temporary tags (Print-on-Demand Temporary Tag Registrations).

How can I issue Temporary Tags (TT) on Sunday, October 25, 2015?
Sign into www.OhioAutoDealers.com to access temporary tag online services. A link will be available to print out a TT registration that is approved for use on this day. Make as many copies as needed. Two copies per tag sold will be needed and both copies must be signed by the customer. Leave the customer’s home address and SSN fields blank on the customer copy only. All tags sold on October 25, 2015, need to be reported online by Tuesday, October 27, 2015. We apologize for any inconvenience this may cause and thank you for your patience during this implementation period.

The use of Ohio Department of Public Safety (ODPS) Identity Manager (IM) must be used to set up all user IDs and passwords. Dealers with a current IM account may use the same sign-on and will simply select the ODPS service needed. IM gives dealerships full control by providing unique User IDs/passwords and access levels to multiple users within each dealership. The link and full instructions for setup can be found on the dealer website home page www.OhioAutoDealers.com. It is recommended that IM be set up PRIOR to the Go Live date of October 26, 2015.NOTE: Current User ID and password will remain effective until October 26, 2015.

As outlined in the Dear Stakeholder letter, all interested parties are invited to offer public comment at BMV-DLR.rules@dps.ohio.gov regarding proposed changes to Chapter 4501:1-3 (Motor Vehicle Dealers and Salespersons), of the Ohio Administrative Code (OAC). Public comments may be submitted through 11:59 p.m. on October 13, 2015.

THE IMPLEMENTATION OF THE NEW DEALER ONLINE SERVICES HAS BEEN DELAYED. THE CURRENT SYSTEM, INCLUDING REPORTING TEMPORARY TAGS WILL REMAIN AVAILABLE UNTIL FURTHER NOTICE. ONLINE SERVICES WILL NOT BE SHUTDOWN ON SUNDAY SEPTEMBER 27TH. All USER ID’S STILL NEED TO BE REGISTERED IN IDENTITY MANAGER IN PREPARATIONS FOR THE NEW DEALER ON-LINE SERVICES. PLEASE CHECK THE ‘LATEST NEWS’ ON THE WEBSITE PERIODICALLY FOR UPDATES ON THE NEW RELEASE DATE OF THE DEALER ONLINE SERVICES.

***IMPORATANT INFORMATION***
House Bill 53, 131st General Assembly, effective June 30, 2015, included changes to Revised Code 4503.182 -Temporary licenses; that will make a motor vehicle temporary tag valid for a period of 45 days.

Revised code 4519.10 - Temporary license placard for off-highway motorcycle or all-purpose vehicle, were included in HB 64 and are also valid for a period of 45 days.

Any temporary tags with pre-printed language of "30 DAY" on the tag were recalled and are no longer valid. Any of the pre-printed "30 DAY" tags that were issued to customers after June 30, 2015, law enforcement may confiscate those tags and impound the vehicle or could lead to arrests of the consumers.

NOTE: All important information and updates that could affect your dealer licenses are sent to the dealerships via postal mail. Please ensure that all mail received by the Bureau of Motor Vehicles is shared with all owners and management. We do not send mail for advertisement or promotional purposes only business related information.

As outlined in the Dear Stakeholder letter, all interested parties are invited to offer public comment at BMV-DLR.rules@dps.ohio.gov regarding the proposed rescission of rule 4501:1-4-01 ("Definitions"); proposed new rules 4501:1-4-03 ("Motor Vehicle Salvage Dealer, Salvage Motor Vehicle Pool, or Salvage Motor Vehicle Auction Required to Maintain Net Worth"), and 4501:1-4-24 ("Disqualifying Offenses"); and proposed changes to rules 4501:1-4-02 ("Information to Accompany Application for Motor Vehicle Salvage Dealer's License, Salvage Motor Vehicle Pool License, Salvage Motor Vehicle Auction License, or Buyer's Identification Card"), 4501:1-4-04 ("Place of Business Required for Motor Vehicle Salvage Dealers, Salvage Motor Vehicle Pools and Salvage Motor Vehicle Auctions") and 4501:1-4-22 ("Nature of and Length of Time Records Will be Maintained") of the Ohio Administrative Code. Public comments may be submitted through 11:59 p.m. on September 2, 2015.

IMPORTANT REMINDER REGARDING E-LIEN TITLES
It is important to note the e-lien-holder name and e-code on the application for title as an E-Title when the paperwork is dropped off at the County Clerk of Courts office. Failure to do so will cause a paper title to be submitted to the lien holder and a replacement title (as an e-title) would be required with a replacement fee.

Pursuant to the requirements of Executive Order 2011-011K and Senate Bill 2 of the 129th General Assembly, which requires state agencies, including the Ohio Department of Public Safety, Dealer Licensing Section to review and draft rules in collaboration with stakeholders, assess and justify any adverse impact on the business community (as defined by Senate Bill 2), and provide opportunity for interested parties to provide input on proposed rules.

The Dealer Licensing Section has the following rule, which is an existing rule being reviewed: Ohio Administrative Code, 4501:1-3-08, is the requirements for place of business required for used motor vehicle dealers, which are required to be licensed by Chapter 4517 of the Revised Code.

All parties are invited to offer suggestions, comments, or propose amendments to the attached rule being reviewed. All correspondence can be submitted to sstedtefeld@dps.ohio.gov no later than June 7, 2015. If any amendments are made to the rule, that rule will be drafted and re-submitted to all participating parties for review prior to posting the rule for public comment on the small business regulatory website.
