Electronically Submit Title Transactions

Please be advised that licensed motor vehicle dealerships may set up an account with the Ohio Department of Public Safety (ODPS) to electronically submit title transactions to a Clerk of Court's office. Public Hearing Notice

 

November 3, 2014
The Ohio Motor Vehicle Dealers Licensing Board ("the Board"), will conduct a public hearing pursuant to section 119.03 of the Revised Code (R.C.) to solicit comment regarding proposed actions to rules 4501:1-3-32 and 4501:1-3-33 of the Ohio Administrative Code.

In response to a completed R.C. 106.03 rule review, the following rules are simultaneously proposed for rescission and adoption under their same rule numbers as it is estimated more than fifty percent of each rule has been changed:

4501:1-3-32 (Place of business required for motor vehicle leasing dealers) identifies all physical requirements of an established place of business for a motor vehicle leasing dealer’s license. This rule's content has been reorganized. Under the new rule, no landline telephone is required, the specified number of business hours (30) has been eliminated to avoid presenting significant hardship to small business owners (leasing dealers), and the requirement for dealers to maintain the capability to send and receive documents by facsimile has been replaced with the capability to send and receive documents electronically.

4501:1-3-33 (Place of business required for motor vehicle auction owners) identifies all physical requirements of an established place of business for a motor vehicle auction owner. This rule's content has been reorganized. Under the new rule, no landline telephone is required, the specified number of business hours (20) has been eliminated to avoid presenting significant hardship to small business owners (auction owners), and auction owners may now conduct dealer and general public auctions simultaneously with separate inventories and clearly identified authorized buyers.

Any persons affected by the proposed rules may appear at the hearing and be heard in person, or by an attorney, or both, or may present their position, argument, or contention in writing. Persons may offer and examine witnesses and present evidence to show that the proposed rules will be unreasonable or unlawful if enacted.

Public Hearing Notice

 

September 4, 2014
On August 28, 2014, Rules 4501:1-3-04, 4501:1-3-08, and 4501:1-3-11, related to motor vehicle dealers and sales persons, were filed with JCARR pursuant to a completed five-year, R.C. 119.032 rule review. As required for Rules 4501:1-3-08 and 4501:1-3-11, a public hearing will be held to provide interested parties an opportunity for comment. This hearing is scheduled on October 2, 2014 at 9:00 a.m. at the Ohio Department of Public Safety, 1970 West Broad Street, Room 134, Columbus, OH.

 

 

New Information Regarding Production of the Dealer Plate and Miscellaneous Business Plate Format

Please be advised that the Bureau of Motor Vehicles (BMV) believes that printing the complete dealer plate series e.g. 001 1234, 002 1234, 003 1234, etc. will resolve future inconsistencies with law enforcement agencies when running any plate in their vehicle registration system that is issued by the dealer licensing section.

The manufacturing and printing of the complete dealer plate series format will begin printing on all dealer licensing plates (dealer, special, in transit, etc.) ordered on September 1, 2014 and thereafter. This implementation is not cause for a recall of the current plates, however you may wish to order replacement plates at cost if you prefer your plates to have the same format. New Form

 

August 5, 2014
We have created a new form, BMV 4483 Electronic Web Check Information, to assist our dealer license and salesperson applicants through the electronic web check process. This form supplies the information that is needed in order for the Dealer Licensing Section to receive the results of your electronic background check in the quickest manner. The form also includes instructions for those applicants that are out of state residents.

Please take advantage of this new form when completing any application that requires a web check. With the utilization of this new form, we anticipate a positive outcome in expediting the issuing of licenses that may otherwise be delayed. The Ohio Motor Vehicle Dealers Licensing Board, will conduct a public hearing pursuant to section 119.03 of the Revised Code (R.C.) to solicit comment on the following proposal to adopt rules 4501:1-3-01 and 4501:1-3-02 to the Ohio Administrative Code. These rules are proposed to implement provisions of S.B. 245 (129th General Assembly) pertaining to training required for used motor vehicle dealers prior to licensure.

4501:1-3-01 (Used Motor Vehicle Dealer Training) establishes that every applicant for a used motor vehicle dealer license is required to provide evidence that the applicant completed a training course presented by an authorized training course provider pursuant to section 4517.05 of the Revised Code.

4501:1-3-02 (Used Motor Vehicle Dealer Training; Curriculum and Course Provider Requirements) sets forth the requirements for training providers to become authorized to offer used motor vehicle dealer training courses online or in traditional classroom settings, course curriculum content and instructional methods, as well as course administration.

Any persons affected by the proposed adoption of these rules may appear at the hearing and be heard in person, or by an attorney, or both, or may present their position, argument, or contention in writing. Persons may offer and examine witnesses and present evidence to show that the proposed rules will be unreasonable or unlawful if enacted.

Draft Rules Open for Public Comment

You are invited to offer public comment as outlined in this notice regarding proposed changes to Chapter 4501:1-3 (Motor Vehicle Dealers and Salespersons), of the Ohio Administrative Code (OAC). You are receiving this message pursuant to the requirements of Executive Order 2011-011K and Senate Bill 2 of the 129th General Assembly, which require state agencies, including the Ohio Department of Public Safety, Bureau of Motor Vehicles (BMV), to draft rules in collaboration with stakeholders, assess and justify any adverse impact on the business community (as defined by Senate Bill 2), and provide opportunity for interested parties to submit feedback regarding proposed rules.

Rules 4501:1-3-04 (Dealer required to maintain records), 4501:1-3-08 (Place of business required for used motor vehicle dealers), 4501:1-3-11 (Dealer required to maintain net worth), 4501:1-3-32 (Place of business required for a motor vehicle leasing dealers), and 4501:1-3-33 (Place of business required for motor vehicle auction owner) are being proposed in response to a completed five-year rule review pursuant to section 119.032 of the Revised Code.

Rule 4501:1-3-11 requires a dealer to maintain a net worth in the sum of at least seventy five thousand ($75,000) dollars in order to be issued a motor vehicle dealer’s license. This rule is proposed for amendment to more clearly define assets and liabilities.
All remaining rules in this package are being simultaneously rescinded and proposed as new rules under their same rule numbers due to complete reorganization of content.

Rule 4501:1-3-04 requires dealers to maintain all records for vehicles that have been purchased, leased or sold, require purchase agreements to include the vehicle serial number and the business name and address as listed on the dealer permit, and the retention of all electronic records for electronic motor vehicle dealers. Changes to the new rule reorganized the content for easier reading, increased the record retention requirement from three to five years, and requires purchase agreements to include the dealer's business name and address as listed on the dealer's permit.

Rule 4501:1-3-08 sets forth the business and facility requirements for a used motor vehicle dealer's place of business. Changes to this new rule reorganized the content for easier reading, removed the restriction that business telephone service be limited to landlines, and expanded the Motor Vehicle Dealer Board's discretion to approve a previously licensed new motor vehicle dealer's for a used motor vehicle dealer's license in circumstances where there is unforeseen economic impact preventing the dealer's place of business from meeting all requirements set forth in this rule.

Rule 4501:1-3-32 sets forth the business and facility requirements for a motor vehicle leasing dealer's place of business. Changes to this new rule reorganized the content for easier reading, clarified that no separate office is required for leasing if the leasing motor vehicle dealer is located within a valid new motor vehicle, used motor vehicle, or renting motor vehicle dealership.

Rule 4501:1-3-33 sets forth the business and facility requirements for a motor vehicle auction owner's place of business. Changes to this new rule reorganized the content for easier reading and provides the option to conduct dealer and general public auctions simultaneously, with separate inventories and clearly identified authorized buyers.

Salvage Buyer Identification Card Renewals

 

June 20, 2014
We are experiencing some system errors with the renewal stickers for salvage buyer identification cards. If you have attempted to renew online and received an error message that reads “LICENSE NUMBER CAN NOT BE PROCESSED,” we are aware of the error. We are working to fix the errors and anticipate to have this resolved as early as Wednesday June 25, 2014. Thank you for your patience in this matter.

 

 

Public Hearing for Motor Vehicle Value for an Unclaimed Vehicle Affidavit Rule 4501:1-13-03

The Ohio Department of Public Safety, Bureau of Motor Vehicles (BMV), will conduct a public hearing, Thursday, June 12, 2014, at 10:00 a.m. The hearing will be held at the Ohio Department of Public Safety, Hearing Room 109, 1970 W. Broad St., Columbus, Ohio, for the purpose of soliciting comments on the following rule proposed for adoption to chapter 4501:1-13, “Electronic Filing,” of the Ohio Administrative Code. This rule is being filed to establish the standards and set forth the process by which a person can obtain a title to an unclaimed motor vehicle pursuant to section 4505.101 of the Ohio Revised Code.

4501:1-13-03 (Motor vehicle value for an unclaimed vehicle affidavit) – this rule is proposed for adoption to establish standards fixed by the registrar of motor vehicles that shall set forth the value of the motor vehicle for the purpose of filing an unclaimed motor vehicle affidavit in order to obtain a certificate of title.

Any persons affected by the proposed amendment to this rule may appear at the hearing and be heard in person, or by an attorney, or both, or may present their position, argument, or contention in writing. Persons may offer and examine witnesses and present evidence to show that the proposed rule will be unreasonable or unlawful if enacted.

You are invited to offer public comment as outlined in this notice regarding proposed changes to Chapter 4501:1-3 (Motor Vehicle Dealers and Salespersons), of the Ohio Administrative Code (OAC) as outlined in the notice. This rule is being filed in to implement provisions of SB245, 129th General Assembly, regarding the mandatory training for used motor vehicle dealers.

Rules 4501:1-3-01 (Used Motor Vehicle Dealer Training) and 4501:1-3-02 (Used Motor Vehicle Dealer Training: Curriculum and Course Provider) are being proposed to implement recent changes to section 4517.05 of the Revised Code requiring all applicants for a used motor vehicle dealer’s license to successfully complete a mandatory training course prior to making application for licensure.

Rule 4501:1-3-01 sets forth the statutory requirement for training and requires every applicant to provide evidence of its successful completion. Rule 4501:1-3-02 sets forth the requirements for becoming an authorized course provider, the curriculum and instructional content for the training courses, and the requirements for course administration
