Important Changes for Out-of State Inspection Forms

 

November 1, 2013
Effective November 5, 2013, the newly designed print-on-demand (POD) out of state inspection (OSI) form BMV 3706 will be available to all dealers via online services on the dealer website at www.ohioautodealers.com. We ask that all current inventories be depleted prior to utilizing the POD version.

The new design is an 8.5" x 11" single sheet that is no longer numerically numbered. Therefore, there will no longer be a need to place orders with the dealer licensing section after the "go live" date.

After completing research and effective utilization of existing technologies, we found that incorporating POD along with the OSI forms would be of great benefit to not only the dealer but to the state agency as well. This process will enable the dealer to have access to the form as needed without the inconvenience of maintaining inventory. That being said, the dealer is still responsible for proper use of the forms and the following guidelines:

- Forms are NOT to be sent to any dealer/customer that is out of state, NO EXCEPTIONS! There are specific procedures in place with the Clerk of Courts for those who are located out of state and in need of an inspection.)
- Inspections that are performed MUST be done ONLY at the dealership location.
- Dealers may NOT charge a customer more than $3.50 per inspection.
- The completed OSI form is to be given to the customer.

All versions of the BMV 3706 will be accepted by the Clerk of Courts in order to deplete inventories of the current form. If there are any questions, please feel free to contact a dealer representative at (614) 752-7636 to assist in any way.

 

 

Technical Difficulties

We apologize for the inconvenience, but we are experiencing some technical difficulties receiving electronic webcheck results from the Bureau of Criminal Investigation (BCI&I). We are currently working with BCI&I on this issue.

We are also experiencing some technical difficulties with the manufacturing of all plates issued by the dealer licensing section. We are currently working with our IT section to resolve the issue. Please allow for additional time to receive your plates for all orders that were placed October 1, 2013, through October 8, 2013. Again we apologize for the inconvenience and working diligently on the issues.

 

 

System Difficulties

Public Hearing for Ohio Bureau of Motor Vehicles Rules 4501:1-3-07 and 4501:1-3-09

The Ohio Motor Vehicle Dealers Licensing Board will conduct a public hearing, Thursday, July 25, 2013 at 9: 00 a.m. at the Ohio Department of Public Safety, Room 134, 1970 W. Broad St., Columbus, Ohio.
The Ohio Department of Public Safety, Bureau of Motor Vehicles, will conduct a public hearing for the purpose of section 119.03 of the Revised Code (R.C.) to solicit comment on the following proposed actions to rules 4501:1-3-07 and 4501:1-3-09 of the Ohio Administrative Code in response to a completed R.C. 119.032 five-year rule review.

Out-of-State Inspection Forms

We apologize for the inconvenience, but due to unforeseen increased orders and excessive amounts of voided Out of State Inspection (OSI) forms (BMV3706), we are experiencing a limited inventory access.
At this time the Dealer Licensing Section will only be sending, OSI forms (BMV3706) to those whose current inventory will be depleted approximately on or about July 15, 2013, and those orders will be processed at a minimum amount. All orders submitted for large quantities will be held until the current inventory level is available.

For regulation purposes there will be no on-line orders accepted at this time. If your inventory will be depleted approximately on or about July 15, 2013, you may fax an order form (BMV 4305) to dealer licensing at (614) 752-7220 for a minimum order. Thank you for your patience during this transition.

 

 

Construction Equipment Auction License

The rules for Construction Equipment Auction License, provisions of sections 4517.16, 4517.17, and 4517.18 of the Revised Code set forth by HB114 of the 129th General Assembly will be effective May 23, 2013.

4501:1-3-36 (Construction equipment auction license) – This rule establishes information prescribed by the registrar for application for a construction equipment auction license and the annual report that is to
be submitted by each approved construction equipment auction licensee.

4501:1-3-37 (Construction equipment auction required to maintain records) – This rule establishes that construction equipment auction licensees are required to maintain financial records to provide evidence of the business’ gross annual sales.

 

 

Critical Information for all Suzuki Franchised Dealers

The Bureau of Motor Vehicles, Dealer Licensing Section has closely followed the American Suzuki Motor Corporation bankruptcy proceedings, and is aware of the various ramifications the reorganization Suzuki has on all dealers who hold franchise agreements with American Suzuki Motor Corporation. The purpose of this memo is to assist all Ohio Suzuki franchised licensed motor vehicle dealers transition smoothly. The Dealer Licensing Section has prepared information to assist dealers who have signed Suzuki Automotive Letter Agreement, Service and Parts Agreement (to continue service on Suzuki cars), Participation Agreement, or declined to sign either letter sent by Suzuki.

Please review this information carefully and respond with any information requested in a timely manner. Doing so will make your transition smoother, assist the Dealer licensing section in updating its records, and will avoid potential issues that may bring your dealership in front of the Motor Vehicle Dealer Board.

Public Hearing for Ohio Motor Vehicle Dealers – Construction Equipment Auction

 

March 25, 2013
The Ohio Department of Public Safety, Bureau of Motor Vehicles, will conduct a public hearing on Monday April 15, 2013, at 9:00 a.m. in Room 134, 1970 W. Broad St., Columbus Ohio. The hearing is being held for the purpose of soliciting comments on the following rules proposed for adoption to Chapter 4501:1-3, "Motor Vehicle Dealers and Salespersons," of the Ohio Administrative Code. These rules are being filed to implement provisions of sections 4517.16, 4517.17, and 4517.18 of the Revised Code set forth by HB114 of the 129th General Assembly.

Dealer Licensing Temporary Tag Fax-n-Go and Pick-up Orders

 

March 4, 2013
Effective March 15, 2013, the Shipley Customer Service Center will no longer offer the bulk consignment temporary tag order service for dealerships. There are alternative options available for ordering temporary tags such as:

1. Online - at www.ohioautodealers.com paying by electronic check and receive the order in 1-3 business days at the license location via UPS with no shipping cost included.

2. Mail-in - a Temporary Tag Order Form (BMV 4381) with a check. The processing time is approximately two weeks and is mailed to the license location via UPS with no shipping costs.

3. Walk-in – bring a completed Temporary Tag Order Form (BMV 4381) to the Department of Public Safety, 1970 W. Broad St., Columbus. Ohio - cash, check, or money order accepted. All orders will be processed within three days and mailed to the license location via UPS with no shipping costs.

Improved Dealer Licensing Applications

 

February 28, 2013
The newly designed dealer licensing applications will be available, March 1, 2013. The new application has a positive change in the licensing process that establishes a benefit to the small business community. The application still has requirements that must be met such as establishing a place of business, prior to the issuance of a dealer’s license. BMV Investigations will perform the physical inspection of the business shortly after license issuance.

This new licensing process will only pertain to new applicants of a Leasing, New, or Used Motor Vehicle Dealer License. Salvage Dealer licenses and miscellaneous business plate applicants will not be included in the new process; In these instances, BMV Investigations will perform the physical inspection prior to license issuance.

 

 

Motor Vehicle Dealer Licensing Board Hearings Cancelled

 

February 27, 2013
All dealer board hearings have been cancelled for February 28, 2013. The BMV will be contacting all dealers who were scheduled to be heard. The public hearing regarding rule 4501:1-3-03, sign required to identify place of business, is still scheduled to be held at 9:00 a.m. at the Ohio Department of Public Safety, Room 134, 1970 W. Broad St, Columbus, Ohio.

 

 

Public Hearing for Ohio Motor Vehicle Dealers Rule 4501:1-3-03

The Ohio Motor Vehicle Dealers Licensing Board will conduct a public hearing pursuant to section 119.03 of the Revised Code (R.C.) on Thursday, February 28, 2013, at 9:00 a.m. The hearing will be held at the Ohio Department of Public Safety, Room 134, 1970 W. Broad St., Columbus, Ohio.

Rule 4501:1-3-03 requires each dealership to be equipped with a prominently displayed, permanent sign that identifies the name of the dealership. This rule is proposed for amendment to require that the sign be displayed at or near the entrance to the building, if the sign is not visible from the roadway. This proposal is in response to a completed R.C. 119.032 five-year rule review.

All interested parties are invited to attend the hearing. Any persons affected by the proposed rule may appear at the hearing and be heard in person, by an attorney, or both, or may present their position, argument, or contention in writing. Persons may offer and examine witnesses and present evidence to show that the proposed rule will be unreasonable or unlawful.

 

 

Construction Equipment Auction License

 

January 18, 2013
In response to some recommendations, the BMV amended 4501:1-3-36 to expand the application affirmations and drafted new rule 4501:1-3-37 to establish record keeping and annual reporting requirements. The BMV believes that the revised rule drafts adequately address stakeholders' concerns.
