New Motor Vehicle Display

A new motor vehicle dealer that satisfies the requirements of Ohio Revised Code 4517.221 may display up to six new motor vehicles at a location other than the dealer’s established place of business in order to promote or benefit a charitable or civic purpose.

If any provisions as set forth in 4517.221 of the O.R.C. have been violated, the Motor Vehicle Dealer Board may order an administrative penalty for each violation, including but not limited to each sale that occurs, and each day a violation occurs or continues to occur.

Requirements

A motor vehicle display that is being held at a location that is inside the dealer’s area of responsibility (AOR) as assigned by the manufacturer, must comply with the following:

  • The dealer must submit an affidavit with a copy of documented evidence showing the assigned AOR within three business days prior to the planned display site.
  • Assure no other dealer will have a vehicle on display at the location.
  • No contracts may be signed, deposits taken or sales consummated at the location.

NOTE: Test drives may be made available during the display.

A motor vehicle display that is being held at a location that is outside the dealer’s area of responsibility (AOR) as assigned by the manufacturer, must comply with the following:

  • The dealer must submit an affidavit within three business days prior to the planned display site.
  • The dealer must provide a notice of intent to display to every dealer selling the same line-make in the AOR of the display location. Each of those dealers in the AOR must agree to allow the display to occur.
  • Assure no other dealer will have a vehicle on display at the location.
  • No contracts may be signed, deposits taken or sales consummated at the location.
  • A dealer may not display vehicles outside their AOR more than six days during a calendar year.
  • The display may not result in the exceeding of the six-day maximum.
Any dealer displaying motor vehicles outside of their AOR as assigned by the manufacturer bears the responsibility of proving that no dealer of the same line-make within the area objected to the display. In the situation where a dealer of a same line-make object to the display by a dealer who is from outside the AOR, the dealer may not display

NOTE: Test drives may not occur and the vehicles must remain stationary during the display.

Record Retention

All sponsors that have filed an affidavit(s) with the BMV for a motor vehicle display must maintain a copy of the affidavit(s) for their records for one year from the last day of the display.
